Commercial guarantee vs legal guarantee
The statutory legal guarantee (conformity) applies automatically to every sale in the EU and cannot be waived. The commercial guarantee of durability is an additional, voluntary promise by the producer that lasts longer than two years. The GARAN label represents that voluntary commercial guarantee; it never replaces the legal guarantee.
The legal guarantee
The legal guarantee of conformity is statutory. It applies automatically to consumer sales, cannot be contracted away, and exists regardless of any GARAN label.
The commercial guarantee of durability
This is a voluntary promise by the producer that a product will remain durable for a stated period of more than two years, covering the whole product. It is exactly this promise that the GARAN label marks.
The accompanying notice
The regulation also harmonises an information notice about the legal guarantee. You can download the official notice, in colour and black-and-white and in many languages, on the notice page.
